Rules and Waivers

RULES AND SAFETY

Welcome to TUFF Entertainments EP –Day, zombie infested 4K. The apocalypse is here and it’s time to see if you’ve got what it takes to survive. Speed alone won’t save you in this race. Runners will have to navigate the series of challenging obstacles and escape the horde of the undead waiting to claim them as one of their own.

A few guidelines to make your zombie race experience as fun as possible.

WHAT YOU’LL NEED TO SURVIVE and REMINDERS:

•Bring an official form of identification (license, passport, photo ID, etc.). We will not be able to let you into the event otherwise.

•A signed race waiver. Participants under the age of 18 must bring a printed waiver signed by a parent or legal guardian to the event or we cannot let you participate.

•Cash for food, beverages, and zombie gear

•You will be covered in mud, zombie guts, body parts, and other apocalyptic liquids after the race, so bring a towel and a change of clothing (especially socks and clean shoes to change into). We will have a “decontamination zone” and changing rooms at the event so you can clean off and enjoy yourself.

•Bring $5 cash for parking, and please have cash ready. We highly recommend you carpool.

•Feel free to bring a lawn chair if you want to stick around and catch some of our live entertainment.

•Check the weather before the event to make sure you are prepared (i.e., umbrellas, warm gear, cold gear, wet gear, etc.).

•Be prepared to get your groove on.

•Costumes are encouraged! ( We are close to Halloween so lets show those Zombies Superman, Batman, Clowns, and Princesses are not afraid to show up) Prizes will be given throughout the day!

•We recommend you arrive at least 1 hour before your wave time to allow time for parking, packet pickup, and travel to the starting line.

RUNNER and ZOMBIE RULES:

Competition Waves

•If all of your flags have been taken, you are NOT automatically transformed into a zombie and you may NOT take another runner’s flags, chase other runners, or pick up flags off the ground.

•Direct and intentional physical contact with any runner or zombie is strictly prohibited. You are not to touch, hit, punch, tackle, roundhouse kick, slap, scratch, pinch, spit on, bite, or do anything harmful to the physical health of our zombies or other runners… no matter how frightened or frightening you may be. Those in violation of this rule will be automatically disqualified and potentially escorted off of the grounds, without refund.

•Flags are to be visible to course officials and zombies (not covered by long clothing or tutus) and to be worn on the sides of the body.

•Participants must wear their EP Z-DAY Bracelet . Participants will not be allowed to race without an official EP Z-DAY Bracelet.

•Working as a team with friends, family, and strangers is allowed and recommended… it’s the living vs. the undead. Use your juicy brains and the ones around you.

•Visibly intoxicated guests will not be allowed to participate in the race. Please arrive to your wave time SOBER.

•Runners and zombies must be 14 years of age or older by race day in order to participate.

GENERAL RULES:

•No weapons or mock weapons will be permitted on the premises.

•No drugs, outside alcohol, or outside food/beverages are permitted on the property. Approved beverages include one factory-sealed water bottle, sports drink, or energy drink up to 1 liter in size.

•No alcoholic beverages are to be consumed by people under the legal drinking age.

•No pets are allowed into the event grounds. Not even if they’re trained to hunt zombies.

•Participants and spectators must abide by all instructions given from the race directors, race staff, volunteers, and medical personnel.

•Do not drink and drive.

•Photographers and videographers will be stationed along the course. Participants, zombies, spectators, and volunteers must sign a waiver to agree to allow the event producer (TUFF Entertainment) to use any pictures or video footage of the event for future promotional purposes.

SAFETY:

Runners can choose to skip an obstacle, but since these are designed to help you escape the zombies’ clutches, it doesn’t bode well for your survival. If there are reasons you cannot complete an obstacle, due to medical reasons, please alert a course official to safely skip the obstacle. You may not skip an obstacle for no reason; there may be penalties. If you skip an obstacle, you will still be able to finish the race. TUFF Entertainment strives to create a fun experience for all those involved. Please be respectful of those around you in the festival area and on the course. Again, any direct and intentional physical contact with any runner or zombie is strictly prohibited. We are serious about this.

In consideration of being allowed to participate in any way in the above referenced TUFF Entertainment Race competition(s), race(s), related

events (the “Event”) and/or activities, I, the undersigned, acknowledge, covenant and agree that:

1. The risk of injury and/or death from the activities involved in the Spartan Race and the Event is significant including, but not limited to the following: (i) drowning;

(ii) near-drowning; (iii) sprains; (iv) strains; (v) fractures; (vi) heat and cold injuries; (vii) over-use syndrome; (viii) injuries involving vehicles; (ix) animal bites and/or

stings; (x) contact with poisonous plants; (xi) accidents involving, but not limited to paddling, climbing, biking, hiking, skiing, snow shoeing, travel by boat, truck, car,

or other convenience;(xii) heart attack and (xiii) the potential for permanent paralysis and/or death. While particular rules, equipment, and personal discipline may

reduce this risk, the risk of death or serious injury does exist;

2. AFTER OPPORTUNITY TO FULLY INFORM MYSELF ABOUT THE EVENT, I KNOWINGLY AND FREELY ASSUME AND ACCEPT ALL SUCH RISKS,

BOTH KNOWN AND UNKNOWN, and assume full responsibility and all risks for my participation in the Event;

3. I voluntarily agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual and/or significant hazard

during my presence or participation, I will remove myself from participation and bring such hazard to the attention of the nearest official;

4. I, for myself and on behalf of my heirs, assigns, personal representatives and/or next of kin, forever WAIVE, RELEASE, DISCHARGE and COVENANT NOT TO

SUE TUFF Entertainment, Cowtown Boots, INC., and I-10 Flea Market LLC. and their officers,

directors, representatives, officials, principals, agents and/or employees, subsidiaries, and/or assigns, as well as their independent contractors, sponsoring agencies,

sponsors, advertisers, volunteers, and if applicable, owners and lessors of the premises used to conduct the Event (collectively, the "Releasees"), WITH RESPECT TO

ANY AND ALL INJURY, DISABILITY, DEATH, and/or loss or damage to person or property, incurred by me in connection with participation in the Event. I further

agree to indemnify, defend and hold harmless Releasees from any loss, liability, cost, claim or damages arising from my participation in or association with activities

and events organized and sponsored by the TUFF Entertainment.. and/or Peak.com, Inc. or connected with the Event.

5. I attest and verify that, unless otherwise indicated below, I am over 18 years of age, am free from all illnesses, injuries and defects that could interfere with my safe

participation in the Event and that I am physically fit and sufficiently trained to participate in all activities associated with the Event. My participation in activities and

events organized or sponsored by TUFF Entertainment is entirely voluntary. I further certify and represent that on the date of the Event I will possess

and be covered by medical/health insurance, individually or as part of an organization.

6. I consent to administration of first aid and other medical treatment in the event of injury or illness and hereby release and indemnify Releasees from any and all

liability or claims arising out of such treatment.

7. The Releasees reserve the right, in their sole and absolute discretion, to postpone, cancel, or modify the event due to weather conditions, Acts of God or other factors

beyond the control of the Releasees that might affect the health and/or safety of the participants. No refunds will be granted.

8. I irrevocably grant unlimited permission to Releasees, to use, reproduce, sell and distribute any and all photographs, images, videotapes, motion pictures, recordings,

or any other depiction of any kind of me or of my participation in the Event or related activity for any legitimate purpose in perpetuity and I understand that I shall not

be entitled to any compensation therefore.

9. I hereby irrevocably and absolutely grant permission to the Releasees to film, videotape and record gratis the performance of the above named participant (referred to

herein as “I”, “me”, “my”) in the Event and subsequently to telecast, sell, distribute and otherwise utilize the same in whatever manner Releasees shall deem

appropriate. Such permission shall include granting the unlimited and irrevocable right to Releasees, without compensation of any kind to me, to use, reproduce or

broadcast, my name, nickname, image, likeness, voice, photograph, signature facsimile, and biographical information in connection with the Event without

compensation of any kind to me. I acknowledge that Releasees and their representatives shall have the unlimited right throughout the world to copyright, use, reuse,

publish, republish, broadcast and otherwise distribute depictions of or information about me and all or any portion of the Event in which I may appear on any and all

radio, network, cable and local television programs and in any print materials and in any other format or media (including electronic media) now known or hereinafter

devised in perpetuity and without compensation to me. In consideration and in return for being allowed to participate in the Event, I release and agree not to sue the

Releasees from all present and future claims regarding my participation in the Events that may be made by me, my family, estate heirs, or assigns.

10. If I am a Zombie or Volunteer I agree to all of the terms and conditions above, and agree to listen to the order and directions of TUFF Entertainment, Their Event Organizers , Staff and any Law Enforcement officials present at the event.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS,

UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY

WITHOUT ANY INDUCEMENT.
